Welcome to Overcame. These Terms of Service (“Terms”) are a binding agreement between you and Overcame (“Overcame,” “we,” “us”) and govern your access to and use of our website, mobile experiences, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Overcame is a technology platform that helps connect you with independent, licensed healthcare providers and licensed pharmacies. Provider services are furnished by the LocumTele provider network, and prescriptions are filled and dispensed by licensed U.S. pharmacies, including Rush Pharmacy.
Overcame is not a pharmacy, medical practice, or insurer, and does not itself practice medicine or dispense medication. The providers and pharmacies are solely responsible for the medical services and products they provide.
You must be at least 18 years old, a resident of the United States, and located in a state we serve to use the Services.
Service area: The Services are currently available in 49 states. We do not serve California. If you are located outside our service area, you may not be able to complete a visit.
The Services are not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. The Services are not a substitute for in-person care when in-person care is required.
Any medical consultation is provided by an independent licensed provider who exercises their own professional judgment. Completing a visit does not guarantee that you will be prescribed any medication. A provider may determine that a requested treatment is not appropriate for you.
You agree to provide accurate and complete health information. Withholding or misrepresenting information may result in inappropriate treatment and is done at your own risk.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate account information and keep it up to date.
Prices for treatments are shown before you check out. Where a subscription is offered, by enrolling you authorize us and our payment partners to charge your payment method on a recurring basis according to the plan you select.
Your payment method may be pre-authorized for the amount shown at checkout. You will only be charged once a licensed provider reviews your information and determines that treatment is appropriate and issues a prescription.
Subscriptions automatically renew until cancelled. To avoid being charged for the next renewal, you must cancel at least 48 hours before your renewal date. You may cancel through your patient portal or by contacting support@overcame.com.
Once a prescription is approved, your medication ships from a licensed pharmacy. For safety reasons, prescription medications generally cannot be returned or refunded once shipped, except as required by law or the dispensing pharmacy’s policies.
You agree not to misuse the Services, including by attempting to gain unauthorized access, interfering with the Services, or using them for any unlawful purpose or to obtain medication for anyone other than yourself.
The Services, including all content, trademarks, logos, and software, are owned by Overcame or its licensors and are protected by law. You may not copy, modify, distribute, or create derivative works without our prior written permission.
The Services rely on third parties, including the LocumTele provider network, dispensing pharmacies such as Rush Pharmacy, and payment and intake providers. Your use of those services may be subject to their own terms and policies. We are not responsible for the acts or omissions of third parties.
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Overcame and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Overcame and its affiliates from any claims, damages, or expenses arising out of your use of the Services or your violation of these Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any disputes will be resolved in accordance with this section, subject to any mandatory consumer protections available to you under applicable law.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
